New York’s income execution is the lesser of 10% of gross pay, 25% of disposable earnings, or the amount above 30 times the state minimum wage — and judgments on hospital or provider medical debt cannot reach wages at all.
Ten percent of gross, under three caps
no amount shall be withheld … unless the disposable earnings of the judgment debtor for that week exceed the greater of thirty times the federal minimum hourly wage … or thirty times the state minimum hourly wage … (iv) no amount shall be imposed in judgments arising from a medical debt action brought by a hospital … or a health care professional
Albany versus Brooklyn
An income execution against a worker grossing $2,200.00 every two weeks with $470.00 withheld takes 10% of gross, $220.00, in Albany and also in Brooklyn ($220.00), because the 25% cap and the 60-hour minimum-wage floor are both less restrictive at this pay. Lower down the scale the regional minimum matters: the New York City-area floor is $1,020.00 for two weeks versus $960.00 upstate.
Medical debt, support and the sheriff
- The 30-times floor uses the regional state minimum: $510 a week in New York City, Long Island and Westchester ($17.00), $480 elsewhere ($16.00). Both rates stay the same on January 1, 2027.§2
- If you already pay support by deduction, the income execution is limited to 25% of disposable earnings minus the support deducted.§1
- The income execution is delivered to the sheriff of the county where you live (or where you work, if you live out of state).§1
- Medical-debt judgments won by hospitals or licensed health-care professionals cannot be collected by income execution.§1
