The dependent reduction

The maximum amount subject to garnishment … for any workweek must be reduced by twenty dollars for each dependent family member residing with the garnishment debtor.

A Fargo parent grossing $1,500.00 every two weeks with $160.00 withheld and three dependents at home starts from the lesser of 25% ($335.00) and the excess over 80 hours of the federal minimum ($760.00). North Dakota then subtracts $20 per dependent per week — $120.00 for this check — leaving $215.00.

Filing the dependent list

  1. You must give your employer a signed list of dependents within ten days of receiving the garnishment summons; otherwise you are presumed to have none until you provide it.§1
  2. The base limit is the lesser of 25% of disposable earnings or the amount above 40 times the federal minimum wage.§1
  3. The $20 reduction is per week, so a biweekly check is reduced by $40 per dependent.§1
