Consumer credit and education loans

(a) 25% of the individual’s disposable earnings for that pay period; (b) the amount by which the individual’s disposable earnings for that pay period exceed 30 hours per week multiplied by the federal minimum hourly wage …; or (c) 15% of the individual’s disposable earnings for that pay period if the judgment relates to an education loan.

A Provo graduate grossing $2,000.00 every two weeks with $260.00 withheld could lose $435.00 to a consumer-credit judgment. If the judgment is on a qualified education loan, Utah caps the garnishment at 15% — $261.00.

What counts as an education loan

  1. An "education loan" here is a closed-end qualified education loan (26 U.S.C. § 221(d)) whose documents say so, including loans made by a depository institution.§1
  2. Utah writes the floor as 30 hours per week times the federal minimum wage — $217.50 a week.§1
