The good-cause reduction in § 24-4.5-5-105
An amount equal to twenty-five percent (25%) of the individual’s disposable earnings for that week or, upon a showing of good cause by the individual why the amount should be reduced, an amount equal to: (i) less than twenty-five percent (25%); and (ii) at least ten percent (10%)
What a judge’s reduction changes
Indiana starts at the federal figure: on a $760.00 weekly check with $110.00 withheld, that is $162.50. A debtor who shows good cause can ask the court to set the percentage anywhere from 10% to just under 25% — at 10% the same check would lose $65.00. Separately, the employer’s processing fee (the greater of $12 or 3% of the total) is split, half charged to the debtor.
