Kansas Wage Garnishment Calculator
Kansas uses the federal 25% / $217.50 limit, but a debt buyer or collection agency that bought or was assigned the account cannot garnish wages at all.
Kansas bars debt buyers from garnishing wages
If any person, firm or corporation sells or assigns an account to any person or collecting agency, that person, firm or corporation or their assignees shall not have or be entitled to the benefits of wage garnishment.
Original creditor versus collection agency
A Wichita worker paid $1,700.00 every two weeks keeps $1,490.00 after withholding. If the hospital that won the judgment garnishes, up to $372.50 per check can be taken under the federal formula Kansas uses. If the hospital sold the account to a debt buyer or assigned it to a collection agency, that assignee cannot use wage garnishment at all.
Thirty-day limits and illness
- The limit is the least of 25% of disposable earnings, the amount above 30 times the federal minimum wage, or the creditor’s claim stated in the order.§1
- One creditor may not issue more than one wage garnishment against you in any 30-day period.§1
- If illness of you or a family member kept you from working for more than two weeks, garnishment cannot be used against you until two months after recovery (shown by your affidavit).§1
- The assigned-account bar does not apply to support rights assigned to the state, state tax collections or court-debt collection contracts.§1
