An Omaha worker grossing $880.00 a week with $150.00 withheld can lose $182.50 if they support no one else. If they actually support relatives they are obliged to support, Nebraska’s head-of-family rule limits the garnishment to $109.50.

Who counts as a head of a family

  1. "Head of a family" means someone who actually supports and maintains relatives by blood, marriage, adoption or guardianship, based on a moral or legal obligation.§1
  2. For pay periods other than a week, Nebraska’s Commissioner of Labor sets the equivalent multiple of the federal minimum wage by regulation.§1
  3. Nebraska’s $15.00 minimum wage does not change the 30-times-federal floor.§2
  4. The statute says the exemptions “shall be granted to any person so entitled without any further proceedings,” and no court may enforce an order that violates them.§1
  5. An employer may not discharge you because your earnings were garnished for any one debt, and any assignment or sale of exempt wages is void.§1
